Barton represents producers, performers, creators, and managers in virtually every sector of the entertainment business—music, film, television, sports, theater, radio, podcasts, and mixed media.

We represent entire entertainment companies as well as individual producers and talent in a multitude of matters, offering our services in regard to transactions, licensing agreements, labor negotiations, and litigation matters, among others.

We are often called upon to advise our entertainment industry clients on complex intellectual property law matters, and to represent them in negotiations with third parties concerning such issues as trademark infringement, licensing, music clearances, copyright infringement, and unfair competition. We also enforce intellectual property rights of clients in state and federal court proceedings, and we defend clients in such proceedings when they have been charged with infringing upon the intellectual property rights of others.

In another vein, our attorneys often manage venture capital funds with a focus in entertainment and handle other financing methods for emerging social media, tech, and music companies catering to the entertainment business. The entertainment industry is particularly fast-moving and specialized, requiring attorneys to have a nuanced, comprehensive understanding of its innerworkings and the laws that govern it.

  • Negotiated Podcasting Agreement for Hip-Hop/Spoken Word Program
    • Negotiated a podcasting agreement for the show Poetics with Omari Hardwick. Represented the producers of the podcast in negotiations with talent and secured all music clearances. Eric also negotiated all TV production agreements for the podcast as well as for the talent featured on the show.
  • Represented NBA in Moving New Orleans Jazz to Utah
    • Represented the National Basketball Association and successfully enabled the league to move the New Orleans Jazz to Utah.
  • Chief Spokesperson in Labor Negotiations for Entertainment Co.
    • Represented a major entertainment company by acting as chief spokesperson in labor negotiations throughout the nation. Over a 17-year period, we were successful in reducing the total number of collective bargaining agreements from over 60 to 0.
  • Represented Singer-Songwriter in Lawsuit, Obtained Dismissal
    • Represented an internationally-known singer and songwriter in a law suit arising from a concert in Europe and obtained a dismissal of the claims against him in a New York state court.
  • Advised on Structuring of Entertainment-Focused Venture Capital Fund
    • Advised a fund sponsor on the structuring, formation, and fundraising for a new venture capital fund focused on media, entertainment, and technology.
  • Advised Music Tech Startup on SAFE Financing
    • Advised a music technology startup with respect to its $150,000 SAFE financing.
  • Reduced Overall Costs of Labor for Entertainment Company
    • Represented a large entertainment company by acting as chief spokesperson in labor negotiations. We were able, in every negotiation, to reduce the overall costs of labor covered by the relevant collective bargaining agreements.
