Intellectual Property

Barton handles the full array of intellectual property services including registration and protection of trademarks and copyrights and coordinates with special counsel on patent prosecution matters. We provide clearance opinions and advice on use and exploitation of a client’s intellectual property. We represent our clients in intellectual property transactions such as licensing agreements, distribution contracts, joint ventures, sales and purchases of intellectual property portfolios. Often, we assist our clients in identifying intellectual property rights belonging to competitors that have the potential to impede or totally disrupt our clients’ businesses. In such circumstances, we often represent our clients in transactions to obtain licenses (or engaging in cross-licensing) of intellectual property rights belonging to others so as to minimize these risks.
In addition, we frequently assist clients in evaluating the value of intellectual property rights during the due diligence phase of mergers, acquisitions, bankruptcy reorganizations and other corporate transactions.

Barton also has an active intellectual property litigation practice that includes patent litigation. Our attorneys have handled complex patent and intellectual property cases in courts throughout the nation for clients across a wide array of industries involving cutting edge technologies and emerging principals of law. We have handled cases for clients in the pharmaceutical, biotechnology, computer, computer software, manufacturing, technology, internet, media and entertainment industries. Successful handling of these cases requires lawyers who combine legal expertise with a keen understanding of our clients’ business objectives. Early case assessments play an increasingly critical role in successfully advising clients in these cases and, thus, we work with our clients and their technical experts at the earliest stages of a litigation or contemplated litigation to carefully evaluate the strengths and weaknesses of every case.
