Partners Joe Harris and Ken Rashbaum recently presented an update to the Association of Corporate Counsel International Legal Affairs Network titled, “A Blessing in Disguise: Why Employers Should Welcome the FTC’s Proposed Non-Compete Ban.”
Joe and Ken examined the FTC’s new proposed rule (and some recent state activity) meant to limit or outright ban non-compete clauses in employment contracts. In light of these impending changes, Joe and Ken discussed the difficulties for employers when they rely too heavily on non-compete agreements to protect their most valuable information. Joe and Ken instead offered practical, actionable steps employers should take to protect their assets, specifically their trade secrets, outside of using non-compete clauses.
