Partner Maurice Ross Comments to NY Post on Litigation Involving Workers Fired for Marijuana Use

On February 15th, the New York Post quoted Partner Maurice Ross in an article titled “NYC tourist bus company fires five non-drivers for legal, medical pot use: suit.”

The article covers an ongoing legal battle between city bus touring company TopView Sightseeing (which is operated by Barton client Go New York Tours) and five employees who were fired for marijuana use. The employees, who allege that the company instituted unlawful drug testing, filed a lawsuit with the Manhattan Supreme Court for unlawful termination.

Maurice Ross, who represents Go New York Tours, told the Post, “Safety is crucial to Go New York Tours that supports and operates buses that carry hundreds of passengers every day. And we cannot tolerate employees who are in positions where safety is critical who use marijuana. It’s a safety concern. We are operating buses on the streets of New York and any actions we have taken have been for the purpose of protecting the safety of our customers.”
