Partner Kenneth Rashbaum was quoted in a recent edition of ED Management, a resource for emergency medicine risk management and malpractice prevention published by Relias Media. In an article titled, “Liability Exposure for Vendor ‘Extremely Difficult’ if AI Tool Used in ED,” Ken comments on the issues of potential liability concerning errors in or complications of treatment that may occur while using artificial intelligence tools. He warns that “[an emergency physician] blaming the AI tool is somewhat analogous to blaming a textbook that the clinician consulted during treatment. A jury would most probably be unimpressed with such a defense and may be hostile to it.”
