Partner Ken Rashbaum was recently quoted in the Fortune magazine article, “The $200 billion playbook that kneecapped Big Tobacco is coming for Mark Zuckerberg and his social media offspring.”

The article chronicles the ongoing lawsuits against YouTube, Snap, TikTok, and Meta that claim the social media giants are harming young people’s mental health through the purposeful promotion of their “addictive” technologies.

Ken speaks to the similarities between these suits and the litigation against Big Tobacco that took place during the 1990s, when litigants sued tobacco companies for producing cigarette advertisements that contained cartoon elements directed towards children.

Ken also comments on the semantics of “marketing and promotion” and “content” and how distinction between these concepts (or lack thereof) could factor into the litigation facing the social media companies.
