Partner Ken Rashbaum Featured as Speaker on Cybersecurity for the Annual IBM/ACC Ethics Webinar

Partner Ken Rashbaum recently spoke at the Annual IBM Ethics webinar, presented in concert with the Association of Corporate Counsel-Westchester/Southern Connecticut. In a presentation titled, “The Impact of Cybersecurity Controls on the Duties of Confidentiality and Communication with the Board and Senior Management,” Ken addressed the ethical challenges of practicing law across electronic frontiers as cybercrime increases exponentially. The webinar covered topics such as:

  • How to satisfy the ethics requirements of technological knowledge, competence, and the ability to explain technical challenges to the Board and C-Suite.
  • Relationships between cybersecurity controls & requirements of reasonable care to keep legal advice confidential.
  • Engagement of technical consultants following a cyberattack or data breach in a way that maximizes the availability of privilege regarding the consultant’s reports and communications.
  • Protecting communications across national borders within which privilege laws may differ significantly from those in the U.S.

The webinar was moderated by Catherine Quinlan, Senior Counsel for IBM Corporation and ACC WESTSCT President-Elect.
