Managing Partner Roger Barton Speaks on Trending Legal Topics for ACC International Legal Affairs Network Panel

On July 22, Managing Partner Roger Barton spoke on a panel as part of “Lunch & Learn Around the World: New York and Chicago,” an event hosted by the International Legal Affairs Network (ILAN) of the Association of Corporate Counsel (ACC). These monthly programs tap attorneys from around the world to discuss new legal hot topics and issues in their country or state, especially those most relevant to in-house counsel.

For his part of the panel, Roger touched on some of the most pressing legal issues affecting New York businesses related to antitrust efforts, consumer protection, and employment law, including:

  • The Twenty-First Century Anti-Trust Act – a proposed amendment to New York’s Donnelly Act that would introduce a lower standard for anticompetitive practices.
  • Taxi Tours v. Go New York Tours – a case handled by Barton that resulted in a landmark antitrust ruling in the New York Court of Appeals that substantially expanded the scope of New York state antitrust laws.
  • FAIR Business Practices Act – first expansion of NY’s consumer protection laws in 45 years that holds companies liable for “unfair” and “abusive” acts, not just “deceptive” acts.
  • Algorithmic Pricing – a new NY State law mandates that companies using dynamic pricing based on users’ personal data must be transparent about such uses.
  • Paid Leave & Pay Transparency – updates on NY’s paid prenatal leave and laws requiring employers to post salary/wage ranges in job postings.
  • Use of AI in Employment – legislation, guidance, and best practices related to limiting liability when using AI to screen resumes, identify potential applicants, determine pay raises, etc.
