On December 5, 2024, Managing Partner Roger Barton served as a panelist for the Association of Corporate Counsel’s Mexico chapter on the topic of Commercial Litigation in the U.S.

The event was tailored to in-house attorneys at large Mexican or multinational companies that do business in the U.S., sell goods or services into the U.S., or do business with U.S.-based companies.

Mexico’s legal system (which is based on civil law) often runs counterintuitive to the States’ system, which is based on common law. Roger enumerated these differences by covering various topics, such as:

  • The differences between U.S. Federal and State Courts
  • The concepts of jurisdiction and venue
  • Steps and scope of the litigation process, e.g.,
    • Documentary and live witness discovery
    • Interrogatories
    • Expert discovery
    • Motion practice
  • Current commercial litigation trends and cross-border issues, e.g.,
    • Limitations on discovery
    • Subpoenas
    • The enforcement of foreign judgments
