Erwin F. Lontok focuses his practice primarily on residential and commercial real estate transactional work. Erwin began his career at the legal department of Cendant Corporation. At Cendant Corporation, Erwin was responsible for reviewing, drafting and negotiating franchise agreements for various real estate brokerage firms. In addition, Erwin ensured that these real estate brokerage firms were in compliance with the corporation’s governance policies.

After leaving Cendant Corporation, Erwin associated himself with law firms which not only furthered his base in the commercial real estate world but also exposed him to residential real estate law. Presently, Erwin’s practice embraces both. As a part of his practice, Erwin represents and assists numerous clients with the sale and purchase of their homes as well as their financing needs. In addition, Erwin represents a number of cooperative corporations and condominium boards, to which he provides guidance on internal governance matters and assistance in mortgage refinances. Erwin has extensive experience in drafting and negotiating real estate contracts, commercial lease agreements and loan documents.

Erwin received his law degree from New York Law School in 1998 and his undergraduate degree from the College of Arts of Sciences at New York University in 1995. He is admitted to the bar of the State of New York as well as to the U.S. District Courts for the Southern and Eastern Districts of New York. He is also a member of the American Bar Association, the Association of the Bar of the City of New York and the New York State Bar Association.

Prior to joining Barton, Erwin was a partner at Ebert Lontok, LLC.

  • Prevailed Over Audit by the Department of Taxation and Finance
    • Successfully represented a commercial real estate investor and prevailed over an audit from the Department of Taxation and Finance of the State of New York. Won the case by citing the inapplicability of the Mansion Tax on condo hotels, maintaining and arguing that the Mansion Tax was applicable only on residential properties. As a secondary argument, successfully asserted that the imposition of the commercial tax rate by the NYC Department of Finance precluded the NYS Department of Taxation of Finance from imposing the additional tax.
  • Resolved International Dispute Regarding Payment of the Mansion Tax
    • Successfully represented a homeowner and prevailed over a foreign mission in a dispute regarding the payment of the Mansion Tax. Used thorough knowledge of both international law and case law to demonstrate that foreign entities exempted under the Vienna Convention treaty are still subject to U.S. taxation, if, as was the case here, the entity has waived its exemption by contract.
  • Negotiated Release of Lease for Distressed Corporate Tenant
    • Successfully represented a distressed commercial corporate tenant in the release of its lease. Brought to light a critical error in the language of a “good guy guaranty”, the result being that the client’s landlord was much more willing to negotiate terms of the release favorably towards the corporate tenant.
