PRACTICE AREAS

Barton provides effective and creative personal, financial, charitable and tax representation and planning to individuals, closely held companies, not-for-profit entities, charities and foundations. As a small practice group within a full service corporate and litigation law firm, we are able to provide the kind of confidential, personal advice and attention that people expect from a long-time family lawyer, while employing the financial acumen and resources of a sophisticated corporate law firm.
The group's attorneys work closely with financial institutions, registered investment advisors, certified financial planners and others who act in a fiduciary capacity for our clients. Personal Planning attorneys manage every kind of major asset, from airplanes and art collections to ranches and commercial real estate.
The group provides counsel in connection with valuation and transfer of such assets. The firm's attorneys help owners of closely held businesses create and administer partnerships, LLCs and corporations, which can ensure continuity of control and minimize transfer tax. The members of the Personal Planning group often address multi-jurisdictional issues, both within the US as well as matters that are international in scope.
Members of the Department provide clients with a broad range of services, with particular emphasis on the preservation of wealth and the minimization of wealth transfer and income taxation.
The Department's broad expertise naturally extends to providing individual clients with advice on the most personal of family questions, such as living wills; health care proxies; prenuptial and postnuptial agreements; and separation, divorce and child custody issues. We routinely administer large and complex trusts and estates and handle contested and non-contested probate and trust matters for executors, trustees and beneficiaries. Our attorneys also prepare estate, trust and guardianship accountings.
We represent US citizens and residents and foreign nationals on a global basis and imaginatively respond to their needs, often by crafting estate plans using structures and entities such as domestic and foreign limited partnerships, corporations, limited liability companies, private trust companies, and private and charitable trusts, either alone or in combination. These structures are intended to provide long-term wealth transfer planning while ensuring a minimum of income, gift, estate and other US and non-US transfer and asset-based taxes. Barton's advice enables clients to transfer assets among family members and between generations, smoothly change control of family businesses, and make creative charitable donations.
